1. Introduction

This Privacy Policy (“Policy”) describes how Top Speed AI, LLC, a Texas limited liability company doing business as FortisWorks (“FortisWorks,” “Company,” “we,” “us,” or “our”), collects, uses, protects, and discloses information through our website located at fortisworks.com (the “Website”) and in connection with our software development and related professional services (the “Services”).

FortisWorks provides custom software development, workflow automation, data-processing systems, document-processing tools, integrations, and related technical services primarily to law firms and other professional organizations operating in regulated, confidential, or data-sensitive environments.

FortisWorks is a business-to-business service. The Website and Services are directed to businesses and professional organizations and are not intended as consumer services.

Where FortisWorks processes information on behalf of a Customer pursuant to a Statement of Work, Master Services Agreement, Data Processing Agreement, confidentiality agreement, or other written contract, that agreement may impose additional or different requirements regarding the handling of Customer information. In the event of a conflict concerning Customer data, the applicable written agreement controls.

2. Our Privacy and Data-Minimization Approach

FortisWorks designs software with privacy, confidentiality, internal workflows, and deterministic operation as important architectural considerations.

Depending on the Customer's requirements, software developed by FortisWorks may be designed to operate locally, within the Customer's controlled environment, without transmitting Customer data to FortisWorks, external artificial intelligence services, or other third-party systems.

The particular architecture, hosting model, connectivity, security controls, and data flows for each project are defined by the applicable Statement of Work or technical specification.

Unless expressly authorized by the Customer in writing or required by the applicable Statement of Work, FortisWorks does not submit Customer Confidential Information or Customer Content to public or third-party generative artificial intelligence services for model training, inference, analysis, or other processing.

3. Information We Collect

3.1 Website and Business Contact Information

When you contact FortisWorks, request information, schedule a consultation, submit an inquiry, or otherwise communicate with us, we may collect:

  • Your name;

  • Business or firm name;

  • Professional title or role;

  • Business email address;

  • Business telephone number;

  • Information you voluntarily provide concerning your organization, technical requirements, or proposed project; and

  • Records of communications with us.

Please do not submit confidential client information, privileged communications, protected health information, financial account information, credentials, or other sensitive information through general Website contact forms unless FortisWorks has specifically instructed you to do so through an approved secure method.

3.2 Project and Customer Information

During an engagement, FortisWorks may receive information necessary to design, develop, test, deploy, troubleshoot, or support Customer software.

Depending on the project, this information may include:

  • Technical requirements and business processes;

  • Sample documents or test data;

  • Configuration information;

  • System specifications;

  • Customer-provided datasets;

  • Credentials or system access specifically provided for development or support;

  • Software logs and diagnostic information; and

  • Other information identified in the applicable Statement of Work.

FortisWorks seeks to minimize access to production data and confidential client information whenever reasonably practicable.

Where representative, synthetic, anonymized, redacted, or test data can reasonably be used for development and testing, FortisWorks may recommend those alternatives.

3.3 Technical Website Information

When you visit fortisworks.com, our hosting, security, or analytics providers may automatically collect limited technical information such as:

  • IP address;

  • Browser and operating-system information;

  • Device information;

  • Pages viewed;

  • Referring pages;

  • Approximate geographic information derived from IP address;

  • Date and time of access; and

  • Security, diagnostic, and server-log information.

We do not use the Website to build consumer advertising profiles or engage in behavioral advertising based on activity across unrelated websites.

4. How We Use Information

FortisWorks may use information to:

  • Respond to inquiries and consultation requests;

  • Evaluate potential projects;

  • Prepare proposals, specifications, Statements of Work, and estimates;

  • Develop, test, deploy, maintain, and support Customer software;

  • Communicate with Customers concerning projects or services;

  • Process invoices and maintain business records;

  • Improve our Website, development processes, security practices, and Services;

  • Diagnose technical issues;

  • Prevent fraud, abuse, or security incidents;

  • Protect our legal rights;

  • Comply with applicable law; and

  • Perform other activities authorized by the Customer or described in an applicable written agreement.

FortisWorks does not sell Customer information or personal information to third parties for advertising or marketing purposes.

5. Customer Content and Confidential Information

Customer retains ownership of Customer Content provided to FortisWorks.

FortisWorks will use Customer Content only as reasonably necessary to perform the Services, meet contractual obligations, provide authorized support, protect the security and integrity of the Services, or comply with applicable law.

Customer Content may also be governed by confidentiality obligations contained in an applicable Master Services Agreement, Statement of Work, nondisclosure agreement, or other written contract.

FortisWorks recognizes that Customers such as law firms may possess information subject to professional confidentiality duties, attorney-client privilege, work-product protections, contractual restrictions, privacy laws, or other regulatory requirements.

FortisWorks' receipt of information does not itself determine the legal status of that information. Customers are responsible for determining what information FortisWorks may lawfully receive and what safeguards are required for a particular engagement.

6. Artificial Intelligence and External Processing

FortisWorks may use artificial intelligence and other development tools internally for general software engineering, documentation, research, or administrative activities where doing so does not expose Customer Confidential Information or Customer Content contrary to our contractual obligations.

Unless specifically authorized in writing by the Customer or expressly provided for in the applicable Statement of Work, Customer Confidential Information and Customer Content will not be transmitted to public or third-party generative AI systems.

If a project specifically requires an external AI, cloud, API, or third-party processing service, the applicable architecture and data-flow requirements should be identified in the Statement of Work or other written project documentation.

7. Service Providers

FortisWorks may use third-party providers to support ordinary business operations, including website hosting, email, communications, accounting, payment processing, source-code hosting, project management, security, backup, and other infrastructure.

We seek to limit information provided to such vendors to information reasonably necessary for the services they perform.

Project-specific use of third-party infrastructure may be further restricted or defined in the applicable Statement of Work.

8. Disclosure of Information

FortisWorks may disclose information:

Service Providers

To vendors and contractors that perform services on our behalf and are subject to appropriate contractual or confidentiality obligations.

Legal Requirements

When we reasonably believe disclosure is required by law, regulation, subpoena, court order, governmental request, or other lawful process.

Where legally permitted and reasonably practicable, FortisWorks may notify an affected Customer before disclosing Customer Confidential Information pursuant to compulsory legal process.

Protection of Rights

Where reasonably necessary to protect the rights, property, security, or safety of FortisWorks, our Customers, or others.

Business Transactions

In connection with a merger, acquisition, financing, reorganization, sale of assets, or similar corporate transaction, subject to applicable contractual confidentiality obligations.

Customer Authorization

For another purpose expressly authorized by the Customer.

9. Data Security

FortisWorks uses reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information it handles.

Depending on the engagement, safeguards may include access controls, encrypted communications, local processing, segregated development environments, credential management, secure development practices, and other project-specific controls.

Security requirements for a particular Customer system should be documented in the applicable Statement of Work, technical specification, security addendum, or other written agreement.

No system, network, transmission method, or storage environment can be guaranteed to be completely secure. FortisWorks therefore does not warrant absolute security.

Customers are responsible for maintaining the security of their own systems, networks, credentials, endpoints, backups, access controls, and infrastructure except to the extent FortisWorks expressly assumes responsibility for a particular item in writing.

10. Data Retention

FortisWorks retains information only for as long as reasonably necessary for the purposes for which it was collected, contractual obligations, legitimate business needs, dispute resolution, security, accounting, or legal compliance.

Retention of project data may be governed by the applicable Statement of Work or other Customer agreement.

When Customer Content is no longer reasonably required, FortisWorks may delete or return it in accordance with the applicable agreement and our technical capabilities.

Certain records, including contracts, invoices, payment records, tax records, and business correspondence, may be retained for longer periods when reasonably necessary for legal, accounting, insurance, or compliance purposes.

Backup copies may remain temporarily within normal backup systems until overwritten or deleted through ordinary retention cycles.

11. Cookies and Website Analytics

The Website may use cookies or similar technologies necessary for website functionality, security, performance measurement, or aggregate analytics.

FortisWorks does not use the Website for cross-site behavioral advertising.

Visitors may control many cookie functions through browser settings. Disabling certain technologies may affect Website functionality.

12. Third-Party Websites

The Website may contain links to third-party websites or services.

FortisWorks is not responsible for the privacy, security, content, or practices of third-party websites. Visitors should review the privacy policies of those services separately.

13. Children

FortisWorks provides business services to professional organizations.

The Website and Services are not directed to children, and we do not knowingly collect personal information directly from children under 18 through the Website.

14. Professional and Regulatory Responsibility

FortisWorks provides software development and technical services. FortisWorks does not provide legal, accounting, regulatory, cybersecurity certification, or compliance advice unless expressly agreed in a written engagement with appropriately qualified professionals.

Customers remain responsible for determining whether a proposed system, workflow, storage method, data flow, retention policy, or security configuration satisfies their professional, ethical, contractual, regulatory, and legal obligations.

FortisWorks will reasonably cooperate with Customers in implementing requirements identified by the Customer and incorporated into the applicable project scope.

15. Changes to This Policy

We may update this Privacy Policy periodically to reflect changes in our Website, Services, business practices, technologies, or legal requirements.

The revised Policy will be posted at fortisworks.com with an updated “Last Updated” date.

Changes to this Website Privacy Policy do not amend project-specific confidentiality, security, privacy, or data-processing obligations contained in an executed contract unless the parties expressly agree otherwise.

17. Effectiveness

This Privacy Policy is effective as of September 14, 2026 and supersedes prior Website privacy notices relating specifically to FortisWorks.

Project-specific obligations remain governed by the applicable contracts between FortisWorks and each Customer.
